Blue Zones Project Yuba Sutter Garden Grant Program Rules

Grant Program Description:

During the 2024-2025 school year, Blue Zones Project Yuba Sutter will award 3 one-time grants up to $2,000 each to public or charter K-12 schools in Yuba Sutter supporting a new or existing edible educational garden located at the school site. Applicants must be Blue Zones approved schools or in the process of becoming a Blue Zones approved school. The goal is to support the development and sustainability of edible educational school gardens and, in doing so, raise awareness of Blue Zones Power 9 Principles of Plant Slant, Purpose, Move Naturally, Belong and Positive Pack.

Grant Timeline:

Application deadline: Wednesday, October 30, 2024 at 5pm PT

Review Period: October 30, 2024 through December 1, 2024

Notification to all applications: Tuesday, December 10, 2024

Fund Restrictions: If awarded, the grant funds may only be used to support the edible educational school garden at the applying school.

If your school is selected to receive a grant, you will be notified no later than December 10, 2024.

Eligibility:

The Blue Zones Project Yuba Sutter School Grant Opportunity (the “Grant Program”) is open to public or charter K-12 schools in Yuba Sutter (zip codes:95991,95993.95901 or 95961), that are either Blue Zones Project approved or working towards approval to be completed in the 2024-2025 school year. (“Participants”). All applicable federal, state, and local rules apply. By entering, Participants agree to be bound by these Official Rules and the final decision of the Sponsor, which shall be made in Sponsor’s sole discretion.

AWARD SELECTION: Three (3) applicants will be selected to each receive a one-time up to $2,000 grant to support their edible school garden. Grant recipients will be notified on Monday, December 10, 2024.

AWARDS: Each of the three winning schools will be awarded a one-time up to $2,000 grant (the “Award” or the “Grant”). Those school awarded a Grant may only use the funds to support the edible, educational school garden at the winning school.

TAXES: Taxes on grant awards and all expenses related to acceptance and use of prize are the sole responsibility of winners.
PARTICIPATION CONDITIONS: By participating, Participants agree: (a) to these rules and decisions of Sponsor, which shall be final in all respects relating to this Grant Program; (b) to release, discharge and hold harmless Sponsor Entities from any and all injuries, liability, losses and damages of any kind resulting from their participation in the Grant Program or their acceptance, use or misuse of prize including, without limitation, personal injury, death and property damage; and if a winner.
LIMITATION OF LIABILITY: Sponsor, Sponsor Entities, and the officers, directors and employees of each are not responsible for and shall not be liable for: (i) any human error which may occur in the processing of entries; (ii) electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, or server malfunction which may occur in the processing of entries; (iii) late, lost, misdirected, stolen, illegible or incomplete entries; or (iv) any condition caused by events beyond the control of the Sponsor that may cause the Grant Program to be disrupted or corrupted. Sponsor reserves the right to cancel, modify or suspend the Grant Program or any portion thereof should virus, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Grant Program. Sponsor may proceed in a manner deemed fair and equitable by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any entry at any time in the event it is determined that the entrant has not complied with these Official Rules.
GOVERNING LAW AND VENUE; WAIVER: PARTICIPANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS GRANT PROGRAM OR ANY GRANT AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY THE APPROPRIATE STATE OR FEDERAL COURT LOCATED IN THE STATE OF THE SPONSOR AS LISTED IN THESE OFFICIAL RULES; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS GRANT PROGRAM BUT IN NO EVENT WILL PARTICIPANT BE ENTITLED TO RECEIVE ATTORNEYS' FEES; AND (3) UNDER NO CIRCUMSTANCES WILL PARTICIPANT BE PERMITTED TO OBTAIN GRANT AWARDS FOR, AND PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED ARE HEREBY WAIVED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participant and Sponsor in connection with the Grant Program, shall be governed by, and construed in accordance with, the laws of the State of Sponsor as listed in these Official Rules, without giving effect to any choice of law or conflict of law rules (whether of the State of Sponsor as listed in these Official Rules or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Sponsor as listed in these Official Rules. This Grant Program is governed by the laws of the State of Sponsor as listed in these Official Rules, with jurisdiction and venue in County of State of Sponsor as listed in these Official Rules and all claims must be resolved in the courts of County of State of Sponsor as listed in these Official Rules.
